Scope and Object of the General Conditions of the Shop

These General Conditions are intended, together with the order form and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Hoyara Jewellery Online Shop Service ("Service" or "Shop") by Hoyara Jewellery, hereinafter referred to as "Hoyara Jewellery".

The Service consists in making available, through the address https://www.hoyarajewellery.com access to the Online Store which, in addition to providing information on a set of products and / or services, allows the User, by electronic means, to order the products disclosed therein, under the terms and conditions described herein.

Product and Content Information

Hoyara Jewellery will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes difficult to control by Hoyara Jewellery, such as human errors or incidents in computer systems, it will not be possible to provide some of the products ordered by the User.

If any product is not available after you have placed your order, you will be notified by email or telephone. At that time you will be presented with the possibility of canceling the order with the respective refund, if you have already made the respective payment.

All information on price, products, specifications, promotional actions and services may be changed at any time by Hoyara Jewellery.


  • All products and services sold in the Hoyara Jewellery Online Store are in accordance with Portuguese Law.
  • The Store has adequate security levels, however Hoyara Jewellery shall not be liable for any losses suffered by the User and/or third parties due to delays, interruptions, errors and suspensions of communications that originate from factors beyond its control, namely, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or arising from the download through the service of files infected or containing viruses or other properties that may affect the User's equipment. If, for any reason of error in accessing the Hoyara Jewellery Online Store website, it is impossible to provide the service, Hoyara Jewellery shall not be liable for any damages.
  • Data and information queries made within the scope of this Service are presumed to have been made by the User, and Hoyara Jewellery declines any liability arising from the abusive or fraudulent use of the information obtained.
  • Hoyara Jewellery shall not be liable for any loss or damage caused by misuse of the Service which is not directly attributable to it by way of intent or gross negligence.
  • Hoyara Jewellery does not guarantee that:
  1. the Service is provided uninterruptedly, is secure, error-free or operates infinitely;
  2. the quality of any product, service, information or any other material purchased or obtained through the Service fulfills any expectations of the User in relation thereto;
  3. any material obtained in any way through the use of the Service is used at the User's own risk, and the User is solely responsible for any damage caused to his computer system and equipment or for any loss of data resulting from such operation.
  4. no advice or information, whether oral or written, obtained by the User from or through the Service shall create any warranty not expressed in these General Conditions.
  • The User accepts that Hoyara Jewellery can in no way be held liable for any damages, including, but not limited to, damages for loss of profits, data, content, or any other losses (even if it has been previously advised by the User of the possibility of the occurrence of such damages), resulting:
  1. the use or inability to use the Service;
  2. the difficulty of obtaining any substitute goods/services;
  3. unauthorized access or modification of personal databases.

Consumer Obligations

  • The user undertakes to:
  1. Provide correct personal details and addresses;
  2. Do not use false identities;
  3. Respect the order limits imposed.
  • If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the order, or possible non-delivery, the User is responsible, and Hoyara Jewellery declines any responsibility. In the event that the consumer violates any of these obligations, Hoyara Jewellery reserves the right to eliminate future purchases, block access to the store, cancel the provision of any other services made available simultaneously by Hoyara Jewellery to the same User; and also not allow future access by the User to any or all services made available by Hoyara Jewellery.
  • It is expressly forbidden to use the products and services purchased for commercial purposes, namely for the purpose of reselling goods.

Privacy and Personal Data Protection

  • Hoyara Jewellery guarantees the confidentiality of all data provided by Users.
  • The User's personal data will be processed and stored by computer and are intended to be used by Hoyara Jewellery within the scope of the contractual and/or commercial relationship with the User.
  • The Internet is an open network, so the User's personal data, other personal information and all content hosted on the Service may circulate on the network without security conditions, even running the risk of being accessed and used by third parties not authorized for this purpose, and Hoyara Jewellery cannot be held responsible for such access and / or use.


According to Portuguese legislation all parts are guaranteed for three years.
The warranty does not cover the natural oxidation of silver or the removal of the gold plating, as well as signs of use, the passage of time, or visible marks of misuse.

Cancellation of orders

You can cancel your order by requesting it from Hoyara Jewellery by emailing the order number, which will be accepted as long as it has not yet been processed.

For the purpose of cancellation, you must provide the following information to Hoyara Jewellery:

  • Order number;
  • Name with which you placed the order and delivery address.

Right of Withdrawal

You may exercise your right of withdrawal without any compensation being required within 14 (fourteen) days of the day on which you acquire physical possession of the goods.

To exercise this right, you should communicate your intention to the email: info@hoyarajewellery.com.

However, please note the following exceptions:

  • No returns of earrings will be accepted for safety and hygiene reasons;
  • No returns will be accepted for parts made to customer specifications or clearly customized.

You must return the goods to Hoyara Jewellery in the proper conditions of use within 14 (fourteen) days from the date of the notice of withdrawal.

The package must be returned complete, as it was delivered and accompanied by all the documentation received, namely the following documents: sales invoice and the document proving receipt of the product. The packaging and the documents indicated must be sent, at the customer's expense, to the following address:

  • Upon receipt of the return at Hoyara Jewellery you will be refunded the amount corresponding to the amount paid for the order (value of the sales invoice). If you have used a promotional discount code, this amount will not be refunded, that is, the refund will only be for the amount actually paid.
  • The method of refunding the amount to be returned depends on the payment method used in the respective order. In the case of credit card and PayPal payments, these are credited to the respective accounts. In other cases, when NIB information is provided, the refund is made to the bank account indicated. The refund is made up to 14 days after receipt of the free resolution will and receipt of the return of the good.
  • In the absence of any of the components of the item sold or, if any of them is not in excellent condition, there will be no refund of the price or postage, and the product will be sent back to the original shipping address.

We do not accept exchanges or returns on any item.


We accept credit card payments (MasterCard, American Express and Visa) through the Stripe and Pay Pal platform, as well as MB Way (exclusive to Portugal) payments.


The delivery time for items is 2 to 5 working days for in-stock parts and up to 10 working days for out-of-stock parts.

Orders will be sent via "CTT Correios de Portugal", with the following deadlines after dispatch:

PORTUGAL Mainland and Islands: 24 to 48 working hours
EUROPEAN UNION: up to 5 working days
REST OF THE WORLD: variable, depending on the place of origin of the order

Intellectual Property

  • The Store is a registered site and the Service provided by the site itself is the responsibility of Hoyara Jewellery.
  • The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.
  • The User undertakes to fully respect the rights referred to in the previous paragraph, namely by refraining from performing any acts that may violate the law or said rights, such as the reproduction, commercialization, transmission or making available to the public of such content or any other unauthorized acts that have as their object the same content.

Safety Conditions of Service

  • The User undertakes to comply with all applicable legal provisions, in particular, not to practice or encourage the practice of unlawful acts or acts offensive to good customs, such as the indiscriminate sending of unsolicited communications (spam) in breach of the legislation applicable to the processing of personal data and advertising communications by means of automatic calling machines.
  • The User expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network susceptible to use by several users, and as such, subject to computer overloads, so Hoyara Jewellery does not guarantee the provision of the Service without interruptions, loss of information or delays.

Suspension and deactivation of the Shop Service

Regardless of any prior or subsequent notice, Hoyara Jewellery may, at any time, and in its sole discretion, discontinue making the Service and or part of the Service available to any or all Users.


  • Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the User that relate to the Service, including any changes to these General Conditions, may be made to the User's email address, by SMS or telephone contact.
  • The User agrees to receive any and all communication and / or notification related to the Online Store, to the address, contact telephone number and / or electronic mail address ("e-mail") indicated in the order process.
  • At any time, you can request not to receive these communications and/or notifications by communicating your intention to the following e-mail address info@hoyarajewellery.com


  • The User may submit any contractual disputes to the arbitration and mediation mechanisms that are or will be legally constituted, as well as complain to Hoyara Jewellery about acts and omissions that violate the legal provisions applicable to the acquisition of goods.
  • The complaint should be communicated to the email info@hoyarajewellery.com within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the User, being registered in the information systems of Hoyara Jewellery, which must decide the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of receipt.
